What is

What is it and what is it for

The aim is to enable the REPORTING to the Directorate-General for Energy of the Generalitat Valenciana on the information to be sent, for each recharging station, by the operators of public access charging points for electric vehicles (CPO) located in the territory of the Comunitat Valenciana, in accordance with the terms of Order TED/445/2023 of 28 April, which regulates the information to be submitted by energy recharging service providers to the Spanish Ministry for Ecological Transition and the Demographic Challenge, the autonomous communities and the cities of Ceuta and Melilla (see link to this regulation in the ‘’Procedure regulations‘’ section).
 

Under this order, all operators of public access recharging points (CPO) are obliged to provide this information (specifically on the characteristics of the recharging points) at the start of the provision of the recharging service and also to keep it duly updated, and therefore MUST REPORT for each recharging station they own:
 

A) The REGISTRATION of each new public access recharging station for electric vehicles, with information on the recharging points associated with it (which will lead to the opening of an ESREAL administrative proceeding).

 

B) MODIFICATION of these recharging stations, such as changes of connector types, changes of charging types, registration and/or deregistration of recharging points of the recharging station, temporary cancellation of the recharging station, etc. (which will open an ESREMO administrative proceeding).

 

C) CHANGE OF OWNERSHIP of these recharging stations (which will open an ESRECT administrative proceeding).

 

D) The DEREGISTRATION of a public access recharging station for electric vehicles (which will open an ESREBA administrative proceeding).

 

* IMPORTANT:

 

1. In accordance with article 3.d of ROYAL DECREE 184/2022 of 8 March, which regulates the activity of providing energy recharging services for electric vehicles (see link in section ‘Procedure regulations’), the following definitions apply:

‘Infrastructure for PUBLIC ACCESS recharging points for electric vehicles’: infrastructure for electric vehicle recharging points located on public roads or which, even if not located on public roads, are accessible to all users of electric vehicles, such as public and private car parks, service stations or shopping centres.

 

2. According to Article 3.4 of the aforementioned ORDER TED/445/2023 and Article 2 of REGULATION (EU) 2023/1804 of the European Parliament and of the Council of 13 September 2023 on the deployment of alternative fuels infrastructure and repealing Directive 2014/94/EU (see link to both regulations under ‘Procedural regulations’), the following terms, among others, are understood to mean:

- ‘recharging STATION’ means a set of one or more recharging points that share a physical location.

-  ‘recharging point’ means physical recharging equipment and associated recharging space that may have one or more connectors but is capable of recharging only one electric vehicle at a time.

 

3. This information reporting procedure must be carried out FOR EACH RECHARGING STATION owned by the operator (CPO).

 

4. The installation of the recharging points must have been previously authorised or notified through the low-voltage installation procedure that corresponds in each case and, therefore, the information reporting must also indicate the number or code of the administrative proceeding handled to obtain this authorisation or notification, the number of the low-voltage installation certificate obtained and the CUPS number to which this installation is connected.

The natural or legal person providing energy recharging services for electric vehicles acting as an operator of public access recharging points (CPO)(1), or its representative (3).

 

NOTES:

1) In accordance with article 3.e) of ROYAL DECREE 184/2022 of 8 March, which regulates the activity of providing energy recharging services for electric vehicles (see link in subsection ‘Procedural regulations’ of the ‘Basic information’ section), the following is understood to mean:

 

RECHARGING POINT OPERATOR (CPO): operator, natural or legal person, who holds the rights to operate electric vehicle recharging stations.

The recharging point operator is generally established as the consumer of electrical energy, in compliance with the provisions of Article 6 of Law 24/2013 of 26 December on the Electricity Sector.

Alternatively, the consumer may assign or transfer, in whole or in part, for the purposes of this royal decree, the rights to operate the electric vehicle recharging point infrastructure to third parties, who will assume the rights and obligations of the recharging point operator, in accordance with the provisions of the aforementioned RD 184/2022.’

 

2) Each operator (CPO) will be assigned a unique European identification code type ‘CPO’ by the Spanish ministry responsible for energy (Article 7.2 of Order TED/445/2023 of 28 April).

 

3) In order to carry out procedures BY TELEMATIC MEANS before the Administration of the Generalitat Valenciana acting on behalf of another person (natural or legal) without using an electronic representative certificate, the represented person must previously register that representation in the REGISTRY OF REPRESENTATIVES of the ACCV, or in the ELECTRONIC REGISTRY OF POWER OF ATTORNEY of the General Administration of the State, whose respective information is available in the subsections ‘Help > Links of interest’ within the ‘Basic information’ section of this procedure.

Without this prior registration or without an electronic representative certificate, it is NOT possible to carry out the telematic procedure on behalf of another person. Nevertheless, in these cases it is possible to use the SIGNATURE BOX, which is a built-in functionality of the Citizen Folder to enable the person on whose behalf the telematic procedure is to be carried out to sign the web form(s), the document(s) to be attached (if applicable) and its final submission to the registry. The E-Office of the Generalitat Valenciana  provides help with frequently asked questions about the Citizen Folder, which includes a TUTORIAL ON HOW THE SIGNATURE BOX WORKS (see also in the ‘Links’ subsection of the ‘Basic information’ section of this procedure) and, in addition, the steps to follow will be indicated in the same telematic procedure.

 

How to process

Processing process

1. Each operator (CPO) of a public access recharging station located in the territory of the Comunitat Valenciana MUST ELECTRONICALLY SUBMIT  to the Directorate-General for Energy of the Generalitat Valenciana THE CORRESPONDING NOTIFICATION, which will initiate:

 

 - An ESREAL administrative proceeding in the case of REGISTRATION.

 - An ESREMO administrative proceeding if a MODIFICATION notification has been made.

 - An ESRECT administrative proceeding in the case of CHANGE OF OWNERSHIP.

 - An ESREBA administrative proceeding if a recharging station DEREGISTRATION has been made.

 

The code or number of the open proceeding will be included in the e-mail you will receive after submitting the telematic notification and will also be later available in your Citizen Folder (see direct link to this Folder in the ‘Links’ subsection of the ‘Basic information’ section of this procedure).

 

* IMPORTANT: for the telematic submission of the notification, please see in particular the following:

 - And also in the EXPLANATORY GUIDES on HOW TO COMPLETE the telematic processing for each of the reporting actions included in this procedure (REGISTRATION / MODIFICATION / CHANGE OF OWNERSHIP / DEREGISTRATION), regarding public access recharging stations for electric vehicles, within the ‘Links’ subsection of the ‘Basic Information’ section.

 

2. After this, the aforementioned Directorate-General will send monthly updated information on recharging stations and their associated public access recharging points in the Comunitat Valenciana to the Spanish Ministry responsible for energy.

 

3. However, if it is observed that the notification submitted is NOT correct or complete, the aforementioned Directorate-General will request the CPO that submitted it to rectify it.

 

Rectifications must be carried out through the telematic procedure of this Prop Guide called  called ‘Contribution of documentation to an open proceeding’ at the Directorate-General responsible for INDUSTRY and/or ENERGY and/or MINING of the Generalitat Valenciana (except aid and closed proceedings). 4. The dissemination of the information submitted is to be carried out by the Spanish Ministry responsible for energy under the terms set out in Article 9 of Order TED/445/2023 of 28 April.

Throughout the year, subject to the following deadlines:

 

A) In the case of recharging stations THAT WERE ALREADY IN SERVICE BEFORE 16 MAY 2023:

Operators (CPO) must submit the REGISTRATION notification covered by this procedure within THREE MONTHS of the date this telematic procedure is provided to them, in accordance with the first transitory provision of Order TED/445/2023 of 28 April.

 

B) Beyond that specific circumstance:

The reporting covered by this procedure must be submitted:

 - In the case of REGISTRATION: PRIOR TO THE BEGINNING OF THE ACTIVITY of the provision of the station’s recharging service.

 - And within ONE WEEK AFTER the MODIFICATION, CHANGE OF OWNERSHIP or DEREGISTRATION of the recharging station, so as to keep the information on the recharging station duly updated.

Documentation

To submit the information required in Order TED/445/2023 of 28 April, to the Directorate-General for Energy of the Generalitat Valenciana, operators of public access recharging stations (CPO) located in the territory of the Comunitat Valenciana must ONLY submit the REPORTING that corresponds to their specific case (registration / modification / change of ownership / deregistration), according to the standardised model in the specific WEB FORM available in step 2-Fill in the TELEMATIC procedure, duly completed and digitally signed.

Specifically, this telematic reporting consists of the following WEB FORMS that must be filled in and signed electronically:

 

A) In the case of REGISTRATION or MODIFICATION of a public access recharging station for electric vehicles:

1st - ‘GENERAL DATA’ FORM, in which, among other data, the action to be carried out on the station must be selected (in this case, registration or modification).

2nd - ‘RECHARGING STATION DATA’ FORM, in which the data specific to the public access recharging station must be indicated (CPO data, station location data, opening hours, etc.).

3rd - ‘RECHARGING POINTS AND CONNECTORS’ FORM, where the specific data of the recharging point/s and the connectors associated to the recharging station to be reported must be indicated (identification of the recharging points, maximum recharging power (W) of the specific recharging point, types of connectors, etc.).

 

B) In the case of CHANGE OF OWNERSHIP of a public access recharging station for electric vehicles:

1st - ‘GENERAL DATA’ FORM, in which, among other data, the action to be carried out on the station must be selected (in this case, change of ownership).

2nd - ‘CHANGE OF OWNERSHIP’ FORM, on which the details of the new and previous owners of the recharging station must be indicated.

* Note: it is the new owner (new CPO) of the station who must communicate the change of ownership.

 

C) In the case of DEREGISTRATION of a public access recharging station for electric vehicles:

1st - ‘GENERAL DATA’ FORM, in which, among other data, the action to be carried out on the station must be selected (in this case, deregistration).

2nd - ‘DEREGISTRATION PROCEDURE’ FORM, where the date and reason for the deregistration of the recharging station are to be indicated, understood as the deregistration of all the recharging points.
