What is it and what is it for

 

Obtaining accreditation for training Qualifications and/or Competence Certificates issued in the Comunitat Valenciana for the practice in another European Union Member State of a regulated profession or trade in the industry sectors included in Annex I of Decree 80/2014.

 

This accreditation recognises the professional qualification of the applicant to practice the profession in question in another Member State with the same rights as the nationals of that State.

A) DEFINITIONS

 

In accordance with Article 4 of Royal Decree 581/2017 of June 9th, the following definitions apply:

 

- “Regulated profession or trade”: The activity or set of professional or trade activities for which access, practice, or mode of practice requires specific professional or trade qualifications, as determined by legal, regulatory, or administrative provisions

 

 

- “Professional or trade qualification”: The capacity to access a specific profession or trade, or practice it, officially certified by a training qualification, a competence certificate as defined in Article 19.1.a of RD 581/2017, formal recognition of professional experience, or a combination of these circumstances.

 

- “Training qualification”: Any diploma, certificate, or other qualification issued by an authority of an EU Member State competent in the field, officially confirming vocational training mainly acquired in the Comunitat Valenciana.

 

- “Competence Certificate” as defined in Article 19.1.a of RD 581/2017: Issued by the competent authority of the Member State of origin, in accordance with the legal, regulatory, or administrative provisions of that State, certifying training not covered by a qualification or certificate as defined in paragraphs 2, 3, 4, and 5 of the aforementioned Article 19, either through a specific examination without prior training or through full-time professional practice for three consecutive years or an equivalent period part-time over the last ten years.

 

- “Professional experience”: The actual and lawful practice, full-time or part-time, in an EU Member State, of the profession or trade in question.

Any individual who is a national of a European Union (EU) Member State or the European Economic Area (EEA) or Switzerland, and who meets the requirements outlined below.

 

 

Requirements

 

1. Must be a NATIONAL OF:

 

- One of the 27 European Union Member States: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden.

 

- Or one of the 3 signatory States to the Agreement on the European Economic Area: Iceland, Liechtenstein, Norway.

 

- Or Switzerland (included under a bilateral agreement with the European Union).

 

 

2. MUST HAVE OBTAINED THE PROFESSIONAL QUALIFICATION (*) IN THE COMUNITAT VALENCIANA, which allows them to practice one of the regulated professions or trades in the industry sectors listed in Annex I of Decree 80/2014.

* Note: Currently, “Plumbing Installer” is NOT a regulated profession or trade in the industry sectors in Spain, so this procedure will not be necessary.

 

 

3. AND WISHES TO PRACTICE SAID PROFESSION OR TRADE IN ANOTHER MEMBER STATE OF THE EUROPEAN UNION (EU) or the European Economic Area (EEA) or Switzerland, which requests accreditation indicating both the level of the training qualification or competence certificate submitted for recognition in that State and that this qualification allows practicing the regulated profession or trade in Spain.

 

 

How to process

Processing process

 

1. Submission (in person or online) of the application (using the SOLACRIND form provided as an associated form in this procedure) and the required documentation at the entry registry of the Regional Service of Industry in the corresponding province.

 

2. Registration and review of the submitted application and documentation.

 

3. If the documentation is incorrect or incomplete, the interested party will be given details of what needs to be provided so that the application can go forward.

 

- If the interested party submits the correct and complete documentation, the procedure continues as described in Point 4

 

- If the interested party does NOT submit the correct or complete documentation, the procedure will be suspended and the file will be archived.

 

4. If the documentation is correct and complete, the corresponding Regional Service of Industry will issue an accreditation certificate, which will be notified to the applicant.

 

5. The deadline for issuing the accreditation certificate (where applicable) and notifying the applicant is three months from the date of receipt of the application in the competent authority’s registry.

 

- In cases where the file is incomplete, and the interested party needs to submit the necessary documents, the aforesaid deadline shall not apply until such time as all the requested documents are received and the application file is complete.

Documentation

1. ACCREDITATION APPLICATION, according to the SOLACRIND form attached to this procedure and in accordance with the provisions of Article 8.2 and Annex III of Decree 80/2014.

 

2. DOCUMENTATION that must be submitted with the application:

 

a) Certified copy of the document proving the nationality and identity of the applicant (passport or identification document), corresponding to one of the European Union (EU) Member States, the European Economic Area (EEA), or Switzerland.

 

If the applicant is a Spanish national, they should only provide this document if they have not authorised the Administration to directly verify their identity data in the accreditation application.

 

b) Certified photocopy:

 

- Either the academic qualification or competence certificate and the professional qualification (if applicable) or the substitute certificate of the qualification or certificate issued by the competent authority.

 

- OR the certification of the training received to obtain the qualification or certificate, including, among other details, the duration of the training and the subjects or modules completed.

 

c) Proof of Payment of the Corresponding Administrative Fee.

a) At the offices of the administrative agencies to which the application is addressed.

b) At the offices of any administrative agency belonging to the General State Administration, any Administration of the Autonomous Communities, any Administration of Provincial Councils, Boards, and Island Councils, Municipalities referred to in Article 121 of Act 7/1985, of April 2, regulating Local Government, or any other entities that make up the Local Administration, provided that, in the latter case, the appropriate agreement has been signed.

c) At Post Offices, as established by regulations.

d) At Spanish diplomatic representations or Consulates abroad.

e) At any other location as specified by the regulations in force.

The deadline for either issuing or notifying (if applicable) the accreditation certificate shall be three months from the date of receipt of the application in the registry of the competent authority.

Observations

 

Applicants may appeal against the administrative decision taken or lack thereof. The maximum period during which such appeals may be filed in the appropriate Administrative Court is stipulated in Act 39/2015, of October 1st covering the Common Administrative Procedure of Public Administrations, and in Act 29/1998, of July 13th, on Administrative Law and that covers jurisdiction and disputes.
